General conditions

Article 1 – Object

• Le seguenti General conditions of sale regulate the offer and the sale of products that appears on the web portals shop.infinitodesign.it and digitalshop.infinitodesign.it (from now on: WEBSITE) owned by the company InfinitoDesign Srl with registered office in Via Pagano 11, Loc. Viazzano, Varano de’ Melegari, Parma, P.IVA n. 02575770348
• The products purchased on the WEBSITE are sold directly by InfinitoDesign Srl
• For purchases made by Customers who are merchants, wholesaler, resellers, professionals and who purchase for a non-personal use, the purchase operations will be regulated by the standars of the Civil Code.
• The privacy protection will be subjected to the Legislative Decree 196/2003 ”Codice Privacy” and the UE Regulation 679/2016 (GDPR); the Customer to this end will have to read the Privacy Policy present on the WEBSITE and give the consent for the data treatment to be able to proceed to the order.

Article 2 – Acceptance of the General Conditions of Sale

• These General Conditions of Sale and the Privacy Policy must be examined by the customers of the site before concluding the order. The continuation of the order therefore implies the total knowledge of the same and their total acceptance; without reading and accepting them, the order cannot continue.
• By placing the order, the Customer declares to have read and accepted all the general conditions of sale and payment contained therein and declares to have read the Privacy Policy carefully and in its entirety, to know its content well and to have expressed the Consent to the processing of data; by sending their purchase order, the Customer therefore accepts them unconditionally and undertakes to observe them in full, together with the payment methods.
• The Customer undertakes and obliges, once the purchase procedure has been completed, to print and keep these General Conditions of Sale, in compliance with articles 52 and 53 of Legislative Decree n. 206/2005.
• InfinitoDesign Srl offers the products for sale on the site and carries out e-commerce activities exclusively to subjects who have reached the age of 18 (or who are in any case of age), in possession of the ability requirements to access and enter into binding contracts and have an address valid email.
• InfinitoDesign Srl reserves the right not to process orders from subjects who do not have the requirements referred to in the previous points.

Article 3 – Terms of purchase

• Purchases of available products, as illustrated and described online in the relative pages, are made by the Customer at the current price indicated, including taxes and duties which may vary depending on the country of destination of the Product or on legislative changes in progress. plus shipping costs, however displayed at the time of purchase.
• Product availability is updated based on the number of products available since access and the ability to place orders online change the availability of the product, InfinitoDesign Srl does not guarantee the certainty of assigning the goods placed in the cart.

• The Customer, after completing their purchase order, will receive a first e-mail message in which InfinitoDesign Srl merely communicates that it has received the order, indicating its number; in the following hours, even if this time indication is not binding, InfintoDesign Srl will send another email to the Customer to communicate the acceptance of the order, confirming the sending of the product(s) to the indicated address and providing the user with a forecast about delivery times. Upon receipt of the emails, the Customer will be able to verify the correctness of the data and products purchased and possibly report and/or request information to info@infinitodesign.it
• the customer can check the status of the order on the page of the orders placed.
• Orders can have these states:
  • CONFIRMED: the order has been completed by the Customer. As long as it is in this state, the order can be canceled by the customer. In case of non-payment it enters a few days, the order is automatically canceled;
  • ACCEPTED: the order is processed and the warehouse prepares the goods for dispatch;
  • SHIPPED: the products relating to the order have been delivered to the courier carrying out the transport;
  • DELIVERED: the order is delivered to the customer.
• Installment payments are not allowed unless expressly indicated.
• If the Customer has chosen to pay with the credit cards available and indicated online, the payment must be made at the time of placing the purchase order. The provider automatically verifies, at the time of the order, the operation of the card, sending an e-mail indicating the outcome of the transaction; the credit is actually collected by InfinitoDesign Srl when the goods are shipped or the service is provided.
• Prices are subject to change at any time, but such changes do not affect Orders already confirmed in the manner described above.
• If the credit card issuer or our service provider refuses or for any reason does not authorize or validate the payment, in such circumstances, InfinitoDesign Srl is not responsible for delays or non-delivery of the products ordered.
• In the absence of information necessary to complete the payment, InfinitoDesign Srl reserves the right to automatically cancel the order.
• At no time during the purchase procedure is InfinitoDesign Srl able to know the information relating to the credit card and the credit card number of the purchaser or the financial, property and personal information of the Customer. This is in fact transmitted via a secure connection directly to the portal of the bank or financial company at the time of the Customer’s confirmation. InfinitoDesign Srl is therefore in no case responsible and can be held responsible for any fraudulent or illegal use of credit cards that may be made by third parties during the purchase and payment procedure for the products.
• If the Customer has chosen to purchase through the Paypal, Stripe or Credit Card payment methods, at the end of the order, he is directed to the Paypal or Stripe login page. The amount relating to the order is charged to the Paypal account at the time of order acquisition. In case of cancellation of the order by both the Customer and in the event of non-acceptance by InfinitoDesign Srl, the amount will be refunded to the Customer’s Paypal or Stripe account. In case of cancellation of the order, the cancellation of the transaction will be requested and InfinitoDesign Srl will in no case be held responsible for any damages, direct or indirect, caused by the delay in the non-release of the committed amount by Paypal or Stripe. For each transaction performed with the Paypal or Stripe account, the Customer will receive a confirmation email from Paypal or Stripe. InfinitoDesign Srl reserves the right to cancel and/or suspend the order if Paypal or Stripe sends a message via email reporting anomalies and/or irregularities in the payment; in this case, InfinitoDesign Srl reserves the right to request additional information from the Customer and/or to send copies of documents proving ownership of the card used. In the absence of the required documentation, InfinitoDesign Srl reserves the right not to accept the order without the Customer’s right to claim damages for this reason.
• If the Customer cancels an order booked with a credit card, bank transfer or Paypal payment method, InfinitoDesign Srl will re-credit according to the same methods chosen by the Customer who cannot request a variation of the same.
• The Customer’s data are transmitted in a secure manner that prevents other subjects from learning about them or coming into contact with them. To be sure of having a secure connection, you need to use a latest generation and updated browser capable of transmitting encrypted data with the InfinitoDesign Srl server. To find out if you are in a secure connection, just check that there is the prefix “https” instead of “http” in the page address, and that the padlock in the top bar of the browser is closed. It should be remembered that the credit card details are transmitted to the bank’s secure server only after the Customer’s confirmation click. Until that moment the data reside exclusively on the Customer’s computer.
• InfinitoDesign Srl accepts orders for delivery in the Italian territory and the European Community. There are no deliveries to non-European countries except those indicated in the form of the destination address.
• InfinitoDesign issues electronic invoices, sent or through the interchange system (SDI) or PEC for business users or fiscal drawer for consumer users, and in any case as per the law on trade.
• The shipping fee, to be added to the price of the products purchased, is calculated automatically by the system.
• The Customer is required to check, upon receipt, if the number of packages delivered corresponds to that indicated on the invoice, if the packaging is intact, and if the product delivered to him complies with the order placed; the Customer must sign the delivery note indicating “subject to control over the integrity of the products”, if this does not happen, the Customer will not be able to contest, after delivery, the external non-conformity of the ordered product and the number of packages received.
• Without this involving any constraints for InfinitoDesign Srl, the goods are delivered approximately within 1 or 2 working days from the sending of the order confirmation, always after verifying the regularity of the payment and the execution of the same. In the case of orders with payments other than advance bank transfer where InfinitoDesign Srl has received reports of payment anomalies such as, for example, the mismatch of the name of the registered subject and the credit card holder, the products are delivered within 7 working days from from the verification of the regularity of the payment or in any case starting from the end of the verifications that will become necessary to ascertain the regularity of the payment.
• InfinitoDesign Srl recognizes the possibility of returning the goods, within 15 days of delivery, for discrepancies with respect to what was ordered and/or for defects in the product.
• An online procedure is available for the return under warranty that can be activated by the customer by accessing the section of the website called RMA.
• The procedure will guide the customer in specifying which products will be returned, the date of purchase, and the reasons for the problem covered by the warranty.
• The cost of the return shipment will be borne by the customer who will have to use his own courier.
• The product, with everything originally contained, must be packed with the original cartons (plastic wrapping, tags …) in order to protect them from damage and sent to InfinitoDesign Srl.
• The refund will be made by issuing a credit note which will be settled by bank transfer within 30 days of its issue.
• Pursuant to the legislation on the protection of personal data, Legislative Decree n. 196/2003 and EU Regulation 679/2016, InfinitoDesign Srl is the ” Owner ” of the processing of the Customer’s data and all the information regarding the use of personal data of the same are summarized in the Privacy Policy document to be accepted before continuing the order. In particular:
  • Purpose of the treatment.
    • commercial, promotional and/or sales purposes to identify specific potential customers for each product and service (e.g. internal statistics, satisfaction feed-back, preliminary acquisitions of information aimed at concluding a contract or supplying goods and services , etc.);
    • research aimed at assessing the degree of customer satisfaction (e.g. research on the quality of services;)
    • fulfillment of obligations established by law, regulations or community legislation.
      
  • Method and place of processing.
    • The processing is carried out by specifically appointed personnel, by letter, telephone, fax, as well as by automated computer systems; the same is carried out at the headquarters of the Company owner and is handled only by persons in charge, with logic strictly related to the purposes highlighted above and, in any case, in such a way as to guarantee the security and confidentiality of the data (with particular regard to the case of use of remote communication techniques).
      
  • Data communication.
    • The personal data collected by InfinitoDesign Srl will be communicated and / or processed by subjects we trust, who, for the pursuit of the aforementioned purposes, carry out tasks of an operational, technical and organizational nature. The personal data provided by the Customer are used for the sole purpose of carrying out the service or provision requested by the same; they are not disclosed to third parties, unless the disclosure is required by law or is directly necessary for the required formalities.
    • Credit cards are processed by the secure Paypal or Stripe server and such data never enter our possession.
      
  • Rights of interested parties.
    • The customer has the right to exercise specific rights. The Customer can obtain:
• confirmation or not of the existence of data concerning him, even if not yet registered;
• information about the origin of personal data, the purposes and methods of processing, as well as the logic applied in case of processing carried out with the aid of electronic tools;
• indication of the identification details of the Owner and of the Manager, as well as of the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them;
• the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, as well as updating, rectification or, when interested, integration of data provided that it is not impossible or involves a disproportionate use of means. The Customer may also object, for legitimate reasons, to the processing of personal data concerning him, even if pertinent to the purpose of the collection. The same may also object to the processing of personal data relating to the sending of advertising material or, in any case, aimed at carrying out market research and commercial communication.
• The sales contract is governed by Italian law.
• For any dispute relating to the validity, interpretation or execution of this contract, the Court of Parma will be exclusively competent.
• The conditions contained in this document may be modified by InfinitoDesign Srl without prior notice and will be valid from the date of publication on its website.
• Any complaint must be addressed to InfinitoDesign Srl, via Pagano 111, loc. Viazzano, Varano de ‘Melegari, PARMA, or via PEC to infinitodesign@pec.it
• The contract and all communications will be in Italian.
